Below are a sampling of case results for the month of May. There were 31 misdemeanors avoided by my clients in the 10 work days between May 1 and May 14. The misdemeanors avoided include: DUI 1st offense, DUI 2nd offense, eluding, possession of marijuana, driving under suspended license, no operator’s license, and 25 reckless driving charges. Results are from traffic court in Virginia Beach, Williamsburg, Hampton, Newport News, Chesapeake, Northampton, and Norfolk. A screen shot is included for the more notable wins.

- May 1, 2015 – Virginia Beach General District Court, Charge: Reckless driving by speed for 76/55. Outcome: Reduced to speeding at 19 over.
- May 4, 2015 – Williamsburg General District Court, Charge: No Operator’s License (misdemeanor). Outcome: Reduced to failure to carry a license (a traffic infraction)!
- May 5, 2015 – Chesapeake General District Court, Charge: DUI with a BAC of .145. Outcome: DUI conviction with no active jail time. Read more about DUI defense here.
- May 5, 2015 – Virginia Beach General District Court, Charge: Reckless driving by speed for 80/55. Outcome: Reduced to speeding at 19 over.
- May 5, 2015 – Northampton General District Court, Charge: Reckless driving by speed for 78/55. Outcome: Reduced to improper driving.
- May 5, 2015 – Northampton General District Court, Charge: Reckless driving by speed for 85/55. Outcome: Reduced to speeding at 80/55.
- May 5, 2015 – Newport News General District Court, Charge: Reckless driving by speed for 83/60. Outcome: Reduced to speeding at 19 over.
- May 6, 2015 – Norfolk General District Court, Charge: Reckless driving generally. Outcome: Reckless driving dismissed. We plead not guilty and fought the charge. No court costs or fines!
- May 6, 2015 – Chesapeake General District Court, Charge: Reckless driving by speed for 68/45. Outcome: Reduced to speeding at 19 over.
- May 6, 2015 – Hampton General District Court, Charge: Reckless driving by speed for 86/60. Outcome: Reduced to speeding at 19 over.
- May 7, 2015 – Virginia Beach General District Court, Charge: DUI 2nd offense within 5 years and refusal of breath test. Outcome: DUI (2nd Offense within 5 years) Dismissed. We plead not guilty and fought the charge. Refusal charge null prossed. No court costs or fines!
- May 7, 2015 – Virginia Beach General District Court, Charge: Reckless driving by speed for 79/55. Outcome: Reduced to speeding at 19 over.
- May 7, 2015 – Virginia Beach Circuit Court, Charge: Reckless driving generally. Outcome: 30 days of jail with all 30 days suspended on 1 year of good behavior. $500 fine and no license suspension. (In the lower court, my client got 30 days of jail with 26 days suspended on good behavior, with 30 days license suspension, but we appealed that ruling.)
- May 7, 2015 – Virginia Beach General District Court, Charge: Reckless driving by speed for 58/35. Outcome: Reduced to speeding at 19 over.
- May 8, 2015 – Northampton Circuit Court, Charge: Reckless driving by speed for 84/55 (originally charged as 89/55 RD in the General District Court). Outcome: Reduced to speeding at 84/55, non-criminal.
- May 8, 2015 – Northampton Circuit Court, Charge: Reckless driving by speed for 81/55. Outcome: Reduced to speeding at 81/55, non-criminal.
- May 8, 2015 – Northampton Circuit Court, Charge: Reckless driving by speed for 72/45. Outcome: Reduced to speeding at 72/45, non-criminal.
- May 8, 2015 – Hampton General District Court: Charge: Reckless driving by speed for 82/60. Outcome: Reduced to speeding at 9 over.
- May 11, 2015 – Chesapeake General District Court: Charges: Possession of marijuana 2nd offense, Eluding (misdemeanor), driving on a suspended license 2nd offense, reckless driving and speeding. Outcome: All charges null prossed!
- May 12, 2015 – Norfolk General District Court, six different clients charged with reckless driving by speed. Outcome: all six clients received convictions for traffic infractions that are non-criminal in nature.
- May 13, 2015 – Virginia Beach General District Court, Charge: DUI. Outcome: DUI Null prossed! The prosecutor agreed to drop the charges after he understood the weaknesses of their case.
- May 13, 2015 – Virginia Beach General District Court, Charge: Reckless driving by speed for 63/35. Outcome: Reckless Driving Dismissed. Officer could not prove that his radar gun was properly calibrated. This was my client’s second reckless driving charge within a month in Virginia Beach, so he avoided two reckless driving convictions. No court costs or fines!
- May 14, 2015, Hampton General District Court, Charge: Reckless driving generally, failure to yield on left turn, and running a red light. Outcome: No jail or suspended license on the reckless driving conviction, the other two traffic charges null prossed.
- May 14, 2015 – Norfolk General District Court, Charge: Reckless driving by speed for 49/25. Outcome: Defective equipment, no points.
- May 14, 2015 – Northampton General District Court, Charge: Reckless driving by speed for 77/55. Outcome: Improper driving.
- May 14, 2015 – Northampton General District Court, Charge: Reckless driving by speed for 79/55. Outcome: Improper driving.
